These Terms & Conditions ("Terms") govern your access to and use of Shadow Quest (the "Service"), operated by Fiat Software LLC (trading as Shadow Quest) ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.
1. The Service
Shadow Quest is a treasure-hunt field journal: it lets you save and connect clues, analyze images, study topographic maps, and plan boots-on-the-ground expeditions. We provide the Service on a subscription or one-time-purchase basis.
2. No affiliation; no special knowledge; entertainment only
- Neither Fiat Software LLC nor Shadow Quest is affiliated with, sponsored by, sanctioned by, endorsed by, or partnered with any treasure hunt, puzzle, contest, author, publisher, organizer, or company, including but not limited to any specific named hunt that users may track in the Service.
- We have no special, insider, or privileged knowledge about any treasure hunt, puzzle, or contest. We do not receive clues, hints, solutions, coordinates, or any other information from hunt organizers or their representatives.
- The Service does not provide clues, solutions, or answers, and makes no representation, warranty, or promise — express or implied — that it will help you solve, win, place in, or make progress on any hunt, puzzle, or contest.
- The Service is provided strictly for entertainment and educational purposes. Any references to specific hunts, locations, books, or organizers within the Service or its marketing materials are nominative only and do not imply any relationship.
3. Eligibility & account
You must be of legal age to enter a contract in your jurisdiction, and you must have authority to bind any organization you represent. You are responsible for the confidentiality of your credentials and for all activity under your account. Provide accurate information and keep it up to date.
4. Acceptable use
You must not, and must not allow others to:
- Use the Service unlawfully or for fraudulent or abusive purposes;
- Send spam, malware, or other harmful content;
- Infringe intellectual property rights of any third party;
- Probe, scan, scrape, reverse-engineer, or otherwise interfere with the Service or its security;
- Resell, sublicense, or redistribute the Service or its content.
5. Intellectual property
The Service, including all software, documentation, branding, and related materials, is owned by Fiat Software LLC and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan. Your content remains yours; you grant us a limited license to host and process it solely to provide the Service.
6. Payments, billing, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer-service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.
7. Subscriptions & renewals
Subscription plans renew automatically at the end of each billing period unless canceled. You can cancel any time from your billing settings; access continues until the end of the period you have already paid for. Lifetime purchases are one-time and grant non-transferable access for as long as the Service is operated.
8. Service level & warranties
The Service is provided "as is". We do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Suspension & termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination you may export your data within a reasonable window before deletion.
10. Assumption of risk — field activities
Shadow Quest is a planning and research tool. Any decision to leave your home, enter the outdoors, traverse public or private land, handle equipment, dig, climb, swim, or otherwise act on information organized in the Service is made entirely at your own risk. Treasure hunting and related field activities can be hazardous and may result in property damage, illness, serious bodily injury, or death. You are solely responsible for: assessing terrain, weather, and wildlife conditions; obtaining all required permits and landowner permissions; complying with all applicable laws (including antiquities, trespass, and metal-detecting regulations); and your own physical fitness and safety equipment.
To the fullest extent permitted by law, you release and waive any claim against Fiat Software LLC, its owners, employees, and contractors for personal injury, death, property damage, or any other loss arising out of or related to activities you undertake in connection with information accessed through the Service.
11. Liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or related to these Terms or the Service is capped at the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (for example, liability for fraud, gross negligence, or — where applicable — death or personal injury caused by our negligence).
12. Indemnity
You will indemnify us against claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of Ohio, USA. Disputes will be brought in the courts of Ohio, USA.
14. Changes
We may update these Terms from time to time. Material changes will be notified via the Service or email.
